VC Commissioners Approve Resolutions For 2024

In their last meeting of 2023, on Dec. 20, the Valley County Commissioners approved six resolutions establishing 2024 tasks such as Commissioner meeting dates and office hours, daily rate for incarceration, fees for services provided by the Sheriff, establishing a fire season, establishing a location for posting public notices and changing the standard mileage rate.

Resolution No 1-2024 established Monday, Tuesday, and Wednesday at the Commissioners meeting days to conduct official county business in Room 110 of the Valley County Courthouse. Office hours will be 9 a.m. to 3 p.m..

Resolution No. 2-2024 established the daily rate for incarceration for the 2024 calendar year. It has been determined that the actual costs incurred by the detention facility on an average daily basis for male and female inmates is $80. Therefore, it has been established the confinement costs, other than for actual medical costs, and other than those contracts have been signed with set dates have been established at $80 per day for all male inmates and $80 per day for all female inmates. It was also stated that an inmate is responsible for the actual costs of medication, medical services, or hospitalizations while detained in a detention center, based upon the individual’s ability to pay and/or private provider health care coverage or a bona fide and responsible third-party payer.

Resolution No. 3-2024 established the fixing of fees of the sheriff for services provided. The fees of the sheriff for services rendered include: for service of summons and complaint on each defendant, $75; for making a return of a summons for a person not found in the county, $75; for levying and serving each writ of attachment of execution on real or personal property, $85; for service of attachment on the body or order of arrest on each defendant, $75; for service of affidavit, order and undertaking in claim and delivery $75; for serving a subpoena, $75 for each witness summoned; for serving writ of possession or restitution $75; for trial of the right of property or damages, including all services $75; for taking bond or undertaking in any case authorized by law, $75; for serving every notice, rule or order $75 for each person served; for copy of any writ, process or other paper, when demanded or required by law, $1 for each page up to 10, then 50 cents each page thereafter; for posting the first notice and advertising any property for sale on execution or under any judgement or order of sale, exclusive of cost of publication, $75; additional posting, $25 each; for holding any sheriff’s sale for person or real property on execution of under any judgement or oder of sale, $75: except that if a sale is ordered from the United States District Court, then the fee for conducting the sale, posting notice, and publication shall by the same as charged by the United States Marshals pursuant to federal law; and for cancellation or postponement of sheriff’s sale, $75.

The sheriff is not entitled to a fee for mileage because mileage is included as part of the individual fees above.

Resolution No. 4-2024 established a fire season for the year 2024, beginning January 1, 2024 to December. 31, 2024, during which time no person shall set any forest fire, slash-burning fire, debris-burning fire or open fire within the County protection area without having obtained an official permit to ignite or set fire from the Valley County Sheriff or Dispatch Office, 228-4333, Opt. 2.

Resolution No. 5-2024 established a location for posting a public notice, which includes the bulletin board near the northwest entrance on the first floor of the Valley County Courthouse, the bulletin board located by the door of the Valley County Commissioner’s office and at the office of the Valley County Clerk and Recorder.

Resolution No. 6-2024 established the changing of the standard mileage rate for reimbursement. The Board of County Commissioners set the following rates for all travel effective Jan. 1: county vehicles may be used for county business. When an employee is authorized to travel by motor vehicle, the employee will be reimbursed at the IRS rate of 67 cents per mile,
