NOTICE OF TRUSTEE'S SALE

TO BE SOLD FOR CASH AT TRUSTEE'S SALE on September 28, 2012, at 11:00 o'clock A.M. at the North Entrance to the Valley County Courthouse located at 501 Court Square in Glasgow, MT 59230, the following described real property situated in Valley County, Montana:

A parcel of land situated in a part of Lots 1 and 7 of Section 19, Township 28 North, Range 40 East, MPM, Valley County, Montana, more particularly described as follows: Beginning at a point on the southwesterly right of way line of Montana Highway No. 24, 270 feet northwesterly from the intersection of said southwesterly right of way line of Montana Highway No. 24 with the east boundary line of Lot 7, Section 19, Township 28 North, Range 40 East, MPM, and being the true point of beginning; thence N. 47D 27' W. 321.5 feet along the southwesterly right of way line of Montana Highway No. 24; thence S. 42D 33' W. 210 feet more or less to the thread of the channel of Milk River; thence running southeasterly along the thread of the channel of Milk River to the intersection with a line drawn South 42D 33' W. from the true point of beginning; thence N. 42D 33' E. 266 feet more or less to the true point of beginning. (Deed recorded in book 92 of Deeds on page 120-122, Doc. No. 415801). Excepting therefrom lands conveyed to the State of Montana Highway Commission and more particularly described in book 133 of Deeds on pages 233-234, Doc. No. 80469.

William L Dixon and Carol A Dixon, as Grantor(s), conveyed said real property to Valley County Abstract, as Trustee, to secure an obligation owed to Mortgage Electronic Registration Systems, Inc, as Beneficiary, by Deed of Trust dated July 29, 2005, and recorded July 29, 2005, under Document No. 128827. The beneficial interest is currently held by The Bank of New York Mellon Trust Company, National Association fka The Bank of New York Trust Company, N.A. as successor to JPMorgan Chase Bank N.A. as Trustee. First American Title Company of Montana, Inc., is the Successor Trustee pursuant to a Substitution of Trustee recorded in the office of the Clerk and Recorder of Valley County, Montana.

The beneficiary has declared a default in the terms of said Deed of Trust by failing to make the monthly payments due in the amount of $617.84, beginning April 1, 2009, and each month subsequent, which monthly installments would have been applied on the principal and interest due on said obligation and other charges against the property or loan. The total amount due on this obligation as of April 4, 2012, is $88,158.96 principal, interest at the rate of 6.875% now totaling $18,737.78, late charges in the amount of $278.01, escrow advances of $11,927.71, suspense balance of $-842.38 and other fees and expenses advanced of $7,570.68, plus accruing interest at the rate of $16.60 per diem, late charges, and other costs and fees that may be advanced.

The Beneficiary anticipates and may disburse such amounts as may be required to preserve and protect the property and for real property taxes that may become due or delinquent, unless such amounts of taxes are paid by the Grantors. If such amounts are paid by the Beneficiary, the amounts or taxes will be added to the obligations secured by the Deed of Trust. Other expenses to be charged against the proceeds of this sale include the Trustee's fees and attorney's fees, costs and expenses of the sale and late charges, if any.

Beneficiary has elected, and has directed the Trustee to sell the above described property to satisfy the obligation.

The sale is a public sale and any person, including the beneficiary, excepting only the Trustee, may bid at the sale. The bid price must be paid immediately upon the close of bidding in cash or cash equivalents (valid money orders, certified checks or cashier's checks). The conveyance will be made by Trustee's Deed without any representation or warranty, including warranty of Title, express or implied, as the sale is made strictly on an as-is, where-is basis, without limitation, the sale is being made subject to all existing conditions, if any, of lead paint, mold or other environmental or health hazards. The sale purchaser shall be entitled to possession of the property on the 10th day following the sale.

The grantor, successor in interest to the grantor or any other person having an interest in the property, at any time prior to the trustee's sale, may pay to the beneficiary or the successor in interest to the beneficiary the entire amount then due under the deed of trust and the obligation secured thereby (including costs and expenses actually incurred and attorney's fees) other than such portion of the principal as would not then be due had no default occurred and thereby cure the default.

The scheduled Trustee's Sale may be postponed by public proclamation up to 15 days for any reason, and in the event of a bankruptcy filing, the sale may be postponed by the trustee for up to 120 days by public proclamation at least every 30 days.
