| AMENDED NOTICE OF TRUSTEE'S SALE
The undersigned hereby gives notice that on the 12th day of July, 2012, at the hour of 1:00 o'clock P.M., Mountain Standard Time, at the main entrance of the Valley County Courthouse located at 501 Court Square, Glasgow, Montana, 59230, Stephen R. Brown, Jr., as Successor Trustee under the following described Deed of Trust, under the direction of Bear Paw Credit Union, in order to satisfy the obligation set forth below, will sell at public auction to the highest bidder, for cash, lawful money of the United States of America, payable at the time of sale to the Successor Trustee, without warranty or covenant, express or implied, as to title or possession, the following described real property:
Lots 10 and 12, Block 5, River Addition to Hinsdale, Montana, according to the official plat thereof on file and of record in the office of the Clerk and Recorder, Valley County, Montana.
Shawn G. White, as Grantor, conveyed the above-described real property to Valley County Abstract Company, as Trustee, to secure an obligation owed Bear Paw Credit Union, as Beneficiary; which said obligation is secured by a Deed of Trust dated November 5, 2007, and recorded November 15, 2007, as Document No. 135671, records of Valley County, Montana. The default for which this foreclosure is made consists of the failure by the Grantor or his successor in interest to pay the monthly installments of principal and interest, when due, under the terms of the Borrower's Home Equity Loan Agreement, dated November 5, 2007, for which the above-described Deed of Trust was given as security, and modified by Modification Agreement dated November 14, 2008. The Beneficiary's records indicate that the following sums are now due and owing to the Beneficiary from the Grantor or their successor in interest on the obligation secured by said Deed of Trust:
Principal balance: $3,047.18
Interest on said principal balance at the rate of 6.0% per annum from November 1, 2011, until paid. Beneficiary's reasonable costs incurred for trustee's sale guarantee title report, filing and recording fees, trustee and attorney's fees, expenditures for insurance and other costs for the preservation of his security, to and including the notice period prior to sale, with interest. This sale is a public sale and any person, including the Beneficiary and excepting only the undersigned Successor Trustee, may bid at the sale. Conveyance of the real property to the successful bidder will be made by Trustee's Deed. The sale purchaser shall be entitled to possession of the property on the tenth day following the date of sale. This document amends that certain Notice of Trustee's Sale dated February 22, 2012, recorded February 24, 2012, as Document No. 146503, records of Valley County, Montana.
